2. What data is stored?

SmartTorch stores exclusively locally on your device:

  • Emergency contacts (name + phone number, in local database)
  • Last flashlight brightness value
  • Timer settings and status
  • Pro purchase status (token and timestamp, locally via DataStore)
  • Settings (SMS interval, shake activation)
  • App session count (for rating prompt)

No personal data is transmitted to servers. No account is required.

3. Location Data

GPS location is accessed exclusively during an active SOS signal, when the "Share location" feature is enabled.

  • Location is not permanently stored
  • Location is only transmitted via SMS to emergency contacts you have defined
  • No transmission to servers or third parties
  • SMS is sent via your cellular network (SmsManager API)

4. Advertising & Consent (Google AdMob)

The free version of SmartTorch displays ad banners via Google AdMob. On first launch, a consent dialog appears (Google UMP – User Messaging Platform), which is GDPR-compliant.

  • You can revoke or adjust your consent at any time in App Settings under Privacy & Consent
  • Without consent, no personalized ads are shown
  • Pro purchase removes ads entirely

5. Google Play Billing

The Pro purchase is processed via Google Play Billing. Payment data is processed exclusively by Google and is not accessible to ALCEIT. The purchase token is stored locally on your device to verify Pro status.

6. Data Sharing with Third Parties

Personal data is not shared with third parties, with the following exception:

  • Google AdMob receives technical device data for ad delivery, if you have consented
  • Emergency SMS with GPS location are sent to contacts you have defined (initiated by you)

7. Permissions

  • Camera (FLASHLIGHT) – LED control of the flashlight
  • Send SMS (SEND_SMS) – Only for SOS Auto-SMS, only when enabled
  • Location (ACCESS_FINE_LOCATION) – Only during active SOS
  • Notifications (POST_NOTIFICATIONS) – For the SOS service in background
  • Vibration / Sensors – For shake activation (Pro)

8. Data Storage & Deletion

All data is stored locally on your device in Android DataStore and a Room database. It is automatically deleted when you uninstall the app or clear app data in Android settings. No backup copies exist on external servers.

9. Your Rights (GDPR Art. 15–22)

  • Deletion (uninstall app or clear data)
  • Restriction of processing
  • Withdrawal of advertising consent (in app settings)

📄 Legal

1. Scope of Application

These Terms of Service govern the use of the SmartTorch mobile application ("App") provided by ALCEIT – Ali Celebi, Waldenbucher Str. 23, 71032 Böblingen, Germany ("ALCEIT", "we", "us"). By downloading, installing, or using the App, you agree to these terms.

2. License & Usage

ALCEIT grants you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Redistribute, sell, or sublicense the App
  • Use the App for illegal purposes
  • Circumvent license or payment mechanisms

3. Pro Features & Payment

Pro features are unlocked via a one-time in-app purchase processed through Google Play Billing. All payments are subject to Google Play's terms. Refunds are handled according to Google Play's refund policy.

The Pro license is tied to your Google account and usable on up to 5 devices.

4. Emergency Disclaimer

SmartTorch is not a substitute for official emergency services. The SOS signal and emergency SMS features are auxiliary tools to support emergency situations. In a real emergency, always contact official emergency services (112, 911, or equivalent) first.

ALCEIT assumes no liability for:

  • SMS delivery failures due to network issues
  • GPS inaccuracy or unavailability
  • Device malfunction or battery failure
  • Delayed or unsuccessful signal reception by third parties

5. Limitation of Liability

The App is provided "as is" without warranty of any kind. To the maximum extent permitted by law, ALCEIT shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the App, including but not limited to damages from emergency situations, SMS failures, or device misuse.

Statutory liability for intent and gross negligence, as well as injury to life, body, or health, remains unaffected.

6. SMS & Carrier Costs

Emergency SMS messages are sent via your mobile carrier's SMS service. Standard SMS charges as per your carrier contract apply. ALCEIT does not charge for or process SMS messages.

7. Intellectual Property

All content of the App, including design, source code, logos, and textual content, is the intellectual property of ALCEIT and protected by copyright laws. Third-party components are used under their respective licenses (AdMob, Google Play Billing, Jetpack Compose, etc.).

8. Changes to these Terms

ALCEIT may update these Terms of Service at any time. Material changes will be announced via app update notes. Continued use of the App after changes constitutes acceptance.

9. Termination

You may terminate use of the App at any time by uninstalling it from your device. ALCEIT may suspend or terminate access in case of breach of these terms.

10. Governing Law & Jurisdiction

These Terms of Service are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Böblingen, Germany, where legally permissible.

For consumers residing in the EU, mandatory consumer protection provisions of their country of residence remain unaffected.
