1. Who we are

This Privacy Policy describes how the DressRight AI mobile app ("the App") collects, uses, stores and shares personal data when you use it. By installing and using the App, you agree to the processing described here.

2. Data we process

2a. Anonymous device identifier

The App generates a random UUID on first launch. This ID never contains your name, email, phone number, or any personal identifier. It is used solely to attach subscription entitlements and usage quotas to your installation.

2b. Outfit photos

Free tier: Photos are processed locally on your device. They are not uploaded to our servers.

Pro tier (AI analysis): When you perform an AI analysis, the photo is sent over a certificate-pinned TLS connection to our backend, which relays it to the OpenAI API for image understanding. We do not retain the photo after the analysis completes. Photos are not used for model training.

2c. Subscription + usage data

When you purchase Pro, Google Play Billing issues a purchase token. Our backend stores a hash of that token together with your anonymous device ID, the plan (weekly/monthly), quota usage counters, and expiry date. We use this to enforce plan limits and to let you restore purchases on a new device. See Terms of Service §6.

2d. Analytics + crash reports

We use Firebase Analytics (Google Ireland Limited) to understand aggregate usage (e.g. which modes are popular, which screens users stay on). Events include: app-open, analyses performed, paywall impressions, auto-restore attempt outcomes. No photo content, no prompts, no AI responses are sent to analytics.

We use Firebase Crashlytics to collect anonymous crash stack-traces so we can fix bugs.

2e. Advertising (Free tier only)

Free-tier users see ads from Google AdMob. Before the first ad loads, a Google UMP consent dialog asks whether you allow personalised or only non-personalised ads. You can change this any time in Settings → "Privacy & ad consent".

2f. Content moderation

To protect minors and prevent abuse, the App applies safety filters to photos and AI responses. This happens client-side (regex + blocklists) and server-side (via OpenAI's safety systems). Rejected inputs are logged without retaining the content itself.

3. Legal bases (GDPR Art. 6)

• Contract (Art. 6 §1 lit. b): Subscription management, quota enforcement, AI analysis delivery.
• Legitimate interest (Art. 6 §1 lit. f): Crash reporting, basic app analytics, fraud and abuse prevention.
• Consent (Art. 6 §1 lit. a): Personalised advertising (collected via the UMP dialog); extended analytics events.
• Legal obligation (Art. 6 §1 lit. c): Tax and invoicing records where Google Play forwards them.

4. Who we share data with

• OpenAI, Inc. (USA) — receives photos and text prompts for Pro AI analysis. US transfer based on the EU Commission's adequacy decision / SCCs.
• Google Ireland Limited — Firebase Analytics, Crashlytics, AdMob, Google Play Billing.
• Ionos Cloud (DE) — hosts our backend VPS.

We never sell personal data. We never provide raw photos to third parties beyond the AI inference call described above.

5. Data retention

• Photos: not retained server-side (processed in-flight only).
• Subscription records: kept for the duration of your active subscription + 30 days after expiry, then automatically purged by a scheduled cleanup job.
• Subscription token history: a non-reversible hash of your Google Play purchase token (sha256 + server-side secret) is persisted alongside your remaining quota for the current billing cycle. This prevents the quota counter from being reset by reinstalling the app or deleting app data within the same cycle. The hash contains no personally identifiable information and is automatically purged 30 days after the cycle ends. Legal basis: Art. 6 (1) (f) GDPR — legitimate interest in preventing subscription abuse.
• Anonymous usage events (analysis timestamps): 48 hours.
• Crash reports: per Firebase Crashlytics defaults (up to 90 days).
• Analytics events: per Firebase Analytics defaults (up to 14 months, controllable in your Google account).

6. Your rights under the GDPR

You have the right to:

• Access the data we hold about you (Art. 15)
• Rectify inaccurate data (Art. 16)

• Restrict processing (Art. 18)
• Receive your data in portable format (Art. 20)

7. Children's privacy

The App is rated for users aged 13+ and complies with Google Play's Families policy. We do not knowingly collect personal data from children under 13. If you believe a child has provided data, email us and we will delete it.

8. International transfers

Data transferred to OpenAI (USA) and Google (USA processing) is covered by EU Standard Contractual Clauses and, where applicable, the EU-US Data Privacy Framework.

9. Security

Traffic between App and backend uses TLS with certificate pinning. Secrets are stored in Android's encrypted preferences. Backend data is protected by host firewalling (firewalld + Ionos Cloud edge rules) and minimum-privilege container isolation.

10. Changes to this policy

If we change this policy materially, we will notify you in the App at next launch and update the "Last updated" date above. Continued use after the effective date constitutes acceptance.

Diese Datenschutzerklärung beschreibt, wie die mobile App DressRight AI („die App") personenbezogene Daten bei deren Nutzung erhebt, verwendet, speichert und weitergibt. Mit der Installation und Nutzung der App stimmst du der hier beschriebenen Verarbeitung zu.

2. Welche Daten wir verarbeiten

2a. Anonyme Geräte-ID

Die App generiert beim ersten Start eine zufällige UUID. Diese ID enthält weder deinen Namen, noch E-Mail, Telefonnummer oder andere persönliche Kennungen. Sie dient ausschließlich dazu, Abo-Berechtigungen und Nutzungskontingente deiner Installation zuzuordnen.

2b. Outfit-Fotos

Free-Tier: Fotos werden lokal auf deinem Gerät verarbeitet. Sie werden nicht auf unsere Server hochgeladen.

Pro-Tier (KI-Analyse): Bei einer KI-Analyse wird das Foto über eine zertifikats-gepinnte TLS-Verbindung an unser Backend gesendet, welches es an die OpenAI API zur Bildverarbeitung weiterleitet. Nach Abschluss der Analyse wird das Foto nicht gespeichert. Fotos werden nicht für Modell-Training verwendet.

2c. Abo- und Nutzungsdaten

Beim Kauf von Pro stellt Google Play Billing ein Purchase-Token aus. Unser Backend speichert einen Hash dieses Tokens zusammen mit deiner anonymen Geräte-ID, dem Plan (Weekly/Monthly), Kontingent-Zählern und Ablaufdatum. Das dient der Durchsetzung von Plan-Limits und dem Wiederherstellen von Käufen auf einem neuen Gerät. Siehe Nutzungsbedingungen §6.

2d. Analyse + Absturzberichte

Wir verwenden Firebase Analytics (Google Ireland Limited) zur Auswertung der Gesamtnutzung (z. B. welche Modi beliebt sind, auf welchen Screens Nutzer verweilen). Events sind u.a.: App-Start, durchgeführte Analysen, Paywall-Impressionen, Auto-Restore-Versuche. Weder Foto-Inhalte noch Prompts noch KI-Antworten werden an Analytics gesendet.

Wir nutzen Firebase Crashlytics zur Erfassung anonymer Crash-Stack-Traces zur Fehlerbehebung.

2e. Werbung (nur Free-Tier)

Free-Tier-Nutzer sehen Werbung von Google AdMob. Vor dem ersten Ad-Load wird über einen Google-UMP-Consent-Dialog abgefragt, ob du personalisierte oder ausschließlich nicht-personalisierte Werbung erlaubst. Du kannst diese Einstellung jederzeit in Einstellungen → „Datenschutz & Werbeeinwilligung" ändern.

2f. Content-Moderation

Zum Minderjährigenschutz und zur Missbrauchsprävention werden Fotos und KI-Antworten durch Sicherheits-Filter geprüft. Dies geschieht client-seitig (Regex + Blocklisten) und server-seitig (über OpenAI-Sicherheitssysteme). Abgewiesene Eingaben werden protokolliert, ohne den Inhalt selbst zu speichern.

3. Rechtsgrundlagen (Art. 6 DSGVO)

• Vertrag (Art. 6 Abs. 1 lit. b): Abo-Verwaltung, Kontingent-Durchsetzung, Auslieferung der KI-Analyse.
• Berechtigtes Interesse (Art. 6 Abs. 1 lit. f): Crash-Reporting, grundlegende App-Analyse, Betrugs- und Missbrauchsprävention.
• Einwilligung (Art. 6 Abs. 1 lit. a): Personalisierte Werbung (via UMP-Dialog erfasst); erweiterte Analyse-Events.
• Rechtliche Verpflichtung (Art. 6 Abs. 1 lit. c): Steuer- und Rechnungsunterlagen, soweit von Google Play weitergereicht.

4. Mit wem wir Daten teilen

• OpenAI, Inc. (USA) — erhält Fotos und Text-Prompts für die Pro-KI-Analyse. US-Übermittlung auf Basis des EU-Angemessenheitsbeschlusses / Standardvertragsklauseln.
• Google Ireland Limited — Firebase Analytics, Crashlytics, AdMob, Google Play Billing.
• Ionos Cloud (DE) — Hosting unseres Backend-VPS.

Wir verkaufen keine personenbezogenen Daten. Wir geben keine Rohfotos an Dritte weiter, außer zur oben beschriebenen KI-Inferenz.

5. Speicherdauer

• Fotos: keine serverseitige Speicherung (nur In-Flight-Verarbeitung).
• Abo-Daten: während der aktiven Laufzeit + 30 Tage nach Ablauf, danach automatisch durch Cleanup-Job gelöscht.
• Abo-Token-Verlauf: Ein nicht-umkehrbarer Hash deines Google-Play-Kauftokens (sha256 + serverseitiges Secret) wird zusammen mit deinem aktuellen Quota-Verbrauch innerhalb des laufenden Abo-Zyklus gespeichert. Das verhindert, dass der Quota-Zähler durch Neuinstallation oder Datenlöschung innerhalb desselben Zyklus zurückgesetzt werden kann. Der Hash enthält keine personenbezogenen Daten und wird 30 Tage nach Zyklus-Ende automatisch gelöscht. Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO — berechtigtes Interesse am Schutz vor Subscription-Missbrauch.
• Anonyme Nutzungs-Events (Analyse-Zeitstempel): 48 Stunden.
• Crash-Reports: gemäß Firebase-Crashlytics-Defaults (bis zu 90 Tage).
• Analyse-Events: gemäß Firebase-Analytics-Defaults (bis zu 14 Monate, im Google-Konto steuerbar).

6. Deine Rechte nach DSGVO

Du hast das Recht auf:

• Auskunft über gespeicherte Daten (Art. 15)
• Berichtigung unrichtiger Daten (Art. 16)
• Löschung (Art. 17) — Mail an mail@alceitlabs.com (siehe Lösch-Anleitung)

7. Minderjährigenschutz

Die App ist für Nutzer ab 13 Jahren freigegeben und erfüllt die Google-Play-Families-Richtlinien. Wir erheben wissentlich keine personenbezogenen Daten von Kindern unter 13 Jahren. Falls du glaubst, dass ein Kind Daten bereitgestellt hat, kontaktiere uns, damit wir sie löschen.

8. Internationale Datenübertragungen

Datenübertragungen an OpenAI (USA) und Google (USA-Verarbeitung) sind durch EU-Standardvertragsklauseln und ggf. das EU-US Data Privacy Framework abgesichert.

9. Sicherheit

Der Datenverkehr zwischen App und Backend nutzt TLS mit Certificate-Pinning. Geheimnisse werden in Androids verschlüsselten Preferences abgelegt. Backend-Daten sind durch Host-Firewalling (firewalld + Ionos-Cloud-Edge-Regeln) und Container-Isolation mit minimalen Rechten geschützt.

10. Änderungen dieser Erklärung

Bei wesentlichen Änderungen informieren wir dich beim nächsten App-Start und aktualisieren das Datum oben. Fortgesetzte Nutzung nach dem Stichtag gilt als Zustimmung.

Terms of Service

1. Who provides DressRight AI

DressRight AI (the "App") is provided by Alceit Labs. Business details in the Impressum. Contact: mail@alceitlabs.com. By installing and using the App, you agree to these Terms.

2. What DressRight AI is

DressRight AI is an entertainment and style-feedback service for outfit photos. It uses a template engine (free tier) and AI vision models (Pro tier) to rate and comment on outfits. The service is for users aged 13 and older.

3. Account model

There is no user account. The App operates under an anonymous device ID (see Privacy Policy §2a). Subscription entitlements are tied to your Google Play account; restoring on a new device is via Google Play's Restore Purchases flow (manual or automatic on first launch).

4. Acceptable use

When using the App, you agree not to:

• Upload photos of other people without their consent
• Upload photos of minors other than yourself if you are a minor
• Upload explicit, sexualised, violent, hateful, or illegal content
• Attempt to jailbreak, reverse-engineer, or abuse the AI prompts to bypass safety filters
• Use the App for harassment, bullying, or disparaging specific individuals
• Scrape, rate-limit-evade, or otherwise attack the backend

We reserve the right to rate-limit, suspend, or permanently block your device ID if you violate these rules. Refunds for abuse-triggered suspensions are at our discretion and handled via Google Play.

5. Content feedback nature — not advice

DressRight AI's output is entertainment-grade style feedback, not professional styling, medical, psychological, or body-image advice. The rating is a generated score on a 1–10 scale based on visible clothing choices only. Ratings are not objective; different modes deliberately produce different scores for the same photo.

6. Subscriptions and billing

Two Pro subscription tiers:

• Pro Weekly: €2.99 / week, 15 AI analyses per period
• Pro Monthly: €9.99 / month, 60 AI analyses per period (with 15/week fair-use cap)
• Boost Pack: €2.99 one-time, 15 AI analyses, consumable. Pro add-on — credits are only consumed while a Pro subscription is active. Credits without an active subscription remain in the account but are dormant until subscription resumes; non-expiring and stackable.

Billing is processed by Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Cancellation: Google Play Store → your profile → Subscriptions. Unused quota does not roll over.

Prices shown in euros; local currency is determined by your Google Play region. Taxes apply per your region.

7. Right of withdrawal (EU)

By purchasing a subscription, you expressly request that the digital service be performed immediately. Pursuant to § 356 Abs. 5 BGB (Germany) / EU Directive 2011/83/EU Art. 16 lit. m, you thereby waive your 14-day right of withdrawal once the service performance has begun. You may still cancel renewal at any time via Google Play without reason — cancellation simply prevents the next billing period.

8. Fair-use limits

To protect service quality, we apply per-user rate limits and a daily AI-analysis cap (10 per day for Pro users, regardless of plan). These limits are enforced server-side. Excessive usage may trigger automatic throttling.

9. Free tier + ads

The free tier is supported by Google AdMob advertising. Ad serving is subject to your consent choice in the UMP consent flow. Rewarded-ad bonuses are available up to 2 per 24 hours.

10. Intellectual property

You retain all rights to the photos you upload. By uploading for AI analysis (Pro), you grant us a limited licence to transmit the photo to OpenAI for the sole purpose of generating a response to your request. We do not retain or repurpose your photos.

11. Limitation of liability

DressRight AI is provided "as is". To the maximum extent permitted by applicable law, Alceit Labs is not liable for:

• Indirect, incidental or consequential damages
• Loss of data resulting from device failure or uninstall
• Outages in third-party services (OpenAI, Google Play, Firebase, AdMob)
• Any decision you make based on the AI's entertainment-grade feedback

Nothing in these Terms excludes liability for gross negligence, intent, death or personal injury caused by our negligence, or any liability which cannot be legally excluded.

12. Changes to the service

We may modify, suspend or discontinue features at any time. Material changes affecting your subscription will be announced at least 30 days in advance, and you may cancel before the change takes effect.

13. Changes to these Terms

We may update these Terms. The "Last updated" date above reflects the current version. Continued use after the effective date of an update constitutes acceptance.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers domiciled in the EU, mandatory consumer protection provisions of your country of residence remain applicable.

The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

2. Was DressRight AI ist

DressRight AI ist ein Unterhaltungs- und Stil-Feedback-Dienst für Outfit-Fotos. Er verwendet eine Template-Engine (Free-Tier) und KI-Vision-Modelle (Pro-Tier), um Outfits zu bewerten und zu kommentieren. Der Dienst richtet sich an Nutzer ab 13 Jahren.

3. Account-Modell

Es existiert kein Benutzer-Account. Die App arbeitet mit einer anonymen Geräte-ID (siehe Datenschutzerklärung §2a). Abo-Berechtigungen hängen an deinem Google-Play-Konto; das Wiederherstellen auf einem neuen Gerät erfolgt über Google Plays Restore-Purchases-Flow (manuell oder automatisch beim ersten Start).

4. Zulässige Nutzung

Bei der Nutzung stimmst du zu, dass du NICHT:

• Fotos anderer Personen ohne deren Einwilligung hochlädst
• Fotos Minderjähriger hochlädst, außer es bist du selbst und du bist minderjährig
• Explizite, sexualisierte, gewalthaltige, hasserfüllte oder illegale Inhalte hochlädst
• Versuchst, die KI-Prompts zu jailbreaken, zu reverse-engineeren oder Sicherheits-Filter zu umgehen
• Die App für Belästigung, Mobbing oder Abwertung spezifischer Personen verwendest
• Das Backend scrapest, Rate-Limits umgehst oder anderweitig angreifst

Wir behalten uns das Recht vor, deine Geräte-ID bei Regelverstößen zu drosseln, zu suspendieren oder dauerhaft zu sperren. Rückerstattungen bei missbrauchsbedingten Sperrungen erfolgen nach unserem Ermessen über Google Play.

5. Feedback-Charakter — keine Beratung

Die Ausgaben von DressRight AI sind unterhaltendes Stil-Feedback, keine professionelle Styling-, medizinische, psychologische oder Body-Image-Beratung. Das Rating ist ein generierter Score auf einer Skala 1–10 allein auf Basis der sichtbaren Kleidung. Ratings sind nicht objektiv; verschiedene Modi erzeugen bewusst unterschiedliche Scores für dasselbe Foto.

6. Abos und Abrechnung

Zwei Pro-Abo-Stufen:

• Pro Weekly: 2,99 € / Woche, 15 KI-Analysen pro Zeitraum
• Pro Monthly: 9,99 € / Monat, 60 KI-Analysen pro Zeitraum (mit 15/Woche Fair-Use-Kappe)
• Boost Pack: 2,99 € einmalig, 15 KI-Analysen, verbrauchbar. Pro Add-on — Credits werden nur verbraucht, solange ein aktives Pro-Abo besteht. Credits ohne aktives Abo bleiben im Konto, sind aber inaktiv, bis ein Pro-Abo abgeschlossen wird; nicht verfallend und stapelbar.

Abrechnung über Google Play. Abos verlängern sich automatisch, wenn nicht mindestens 24 Stunden vor Ende der laufenden Periode gekündigt wird. Kündigung: Google Play Store → Profil → Abos. Nicht genutztes Kontingent wird nicht übertragen.

Preise in Euro; die Lokalwährung richtet sich nach deiner Google-Play-Region. Steuern gemäß deinem Land.

7. Widerrufsrecht (EU)

Mit dem Abo-Kauf forderst du ausdrücklich die sofortige Ausführung der digitalen Dienstleistung. Gemäß § 356 Abs. 5 BGB / EU-Richtlinie 2011/83/EU Art. 16 lit. m verzichtest du damit auf dein 14-tägiges Widerrufsrecht, sobald die Leistungserbringung begonnen hat. Du kannst die Verlängerung jederzeit ohne Angabe von Gründen über Google Play kündigen — die Kündigung verhindert lediglich die nächste Abrechnungsperiode.

8. Fair-Use-Limits

Zur Sicherung der Dienstqualität gelten nutzerbezogene Rate-Limits und ein täglicher KI-Analyse-Cap (10 pro Tag für Pro-Nutzer, planunabhängig). Diese Limits werden server-seitig durchgesetzt. Exzessive Nutzung kann automatisch gedrosselt werden.

9. Free-Tier und Werbung

Der Free-Tier wird durch Google-AdMob-Werbung finanziert. Die Ausspielung hängt von deiner Einwilligung im UMP-Consent-Flow ab. Rewarded-Ad-Boni sind bis zu 2-mal pro 24 Stunden verfügbar.

10. Geistiges Eigentum

Du behältst alle Rechte an den hochgeladenen Fotos. Mit dem Upload zur KI-Analyse (Pro) erteilst du uns eine begrenzte Lizenz, das Foto zur Erzeugung einer Antwort auf deine Anfrage an OpenAI zu übermitteln. Wir speichern oder verwenden deine Fotos nicht anderweitig.

11. Haftungsbeschränkung

DressRight AI wird „wie besehen" bereitgestellt. Soweit gesetzlich zulässig, haftet Alceit Labs nicht für:

• Mittelbare, zufällige oder Folgeschäden
• Datenverlust durch Geräteausfall oder Deinstallation
• Ausfälle Drittanbieter-Dienste (OpenAI, Google Play, Firebase, AdMob)
• Entscheidungen, die du auf Basis des unterhaltenden KI-Feedbacks triffst

Nichts in diesen Bedingungen schließt Haftung aus für grobe Fahrlässigkeit, Vorsatz, Tod oder Personenschäden durch unsere Fahrlässigkeit oder jede Haftung, die nicht wirksam ausgeschlossen werden kann.

12. Änderungen am Dienst

Wir können Features jederzeit ändern, aussetzen oder einstellen. Wesentliche Änderungen deines Abos kündigen wir mindestens 30 Tage vorher an; du kannst vor Inkrafttreten kündigen.

13. Änderungen dieser Bedingungen

Wir können diese Bedingungen aktualisieren. Das Datum oben spiegelt die aktuelle Version. Fortgesetzte Nutzung nach Inkrafttreten einer Änderung gilt als Zustimmung.

14. Anwendbares Recht & Gerichtsstand

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Für Verbraucher mit Wohnsitz in der EU bleiben zwingende Verbraucherschutzvorschriften ihres Wohnsitzlandes anwendbar.

Die EU-Kommission bietet eine Plattform zur Online-Streitbeilegung: ec.europa.eu/consumers/odr. Wir sind nicht verpflichtet und nicht bereit, an Streitschlichtungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

DressRight AI is built and supported by Alceit Labs, an independent solo studio based in Böblingen, Germany. We read every email — typical reply within a few working days, always within 30 days for GDPR-related requests (Art. 12).

• Press & partnerships: reviewers, journalists, integration / collaboration ideas.
• Security disclosures: if you found a vulnerability, please disclose responsibly — describe the issue, the impact, and how to reproduce. We acknowledge within 72 hours and will not pursue legal action against good-faith research.

What helps us reply faster

• Tell us your app version (Settings → scroll to bottom; the line reads v1.0.0 (1)).
• Tell us your device + Android version (Settings of your phone → About).
• If support touches your account/data, optionally include your anonymous device ID — long-press the version label in Settings to copy it to clipboard, then paste it.
• For billing issues, include the Google-Play-Order-ID from your purchase email.

Was uns hilft, schneller zu antworten

• App-Version mitsenden (Einstellungen → ans Ende scrollen; die Zeile zeigt z. B. v1.0.0 (1)).
• Gerät und Android-Version nennen (Telefon-Einstellungen → Über).
• Bei Account-/Daten-Themen optional die anonyme Geräte-ID — Versions-Eintrag in den Einstellungen lang drücken kopiert sie in die Zwischenablage, dann einfügen.
• Bei Abrechnungsfragen die Google-Play-Order-ID aus der Kauf-E-Mail mitsenden.
